These Terms of Use govern your access to and use of our website, products and services. By using our website or purchasing from us, you agree to these Terms.

1. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Australia. You agree that the courts of Australia will have exclusive jurisdiction in relation to any dispute arising under or in connection with these Terms.

These Terms are subject to the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), which includes statutory consumer guarantees and protections that cannot be excluded.

Where applicable, electronic agreements, bookings and communications are governed by the Electronic Transactions Act 1999 (Cth).

2. Definitions

Tree of Health / We / Us / Our refers to Tree of Health.
You / Client / Customer refers to any person accessing our website or purchasing products or services.
Products include herbal remedies, teas, tinctures, supplements and wellness items.
Services include naturopathic consultations (in-person and online), programs, workshops and educational material.

3. Medical Disclaimer

Our services and products are provided for general wellness and educational purposes only.

They are not intended to diagnose, treat, cure or prevent any disease and are not a substitute for advice from your GP or other qualified medical practitioner.

Always consult your doctor or healthcare professional before starting any herbal or nutritional program, particularly if you:

  • are pregnant or breastfeeding

  • have a medical condition

  • are taking prescription medication

You acknowledge that any decision to use our products or services is made at your own discretion and risk.

4. Eligibility

You must be at least 18 years of age to purchase products or book consultations through our website.

5. Consultations & Appointments

  • All consultations must be paid in full at the time of booking unless otherwise agreed.

  • Appointment times are reserved specifically for you.

  • Cancellation or rescheduling requires at least 24 hours’ notice.

  • Late cancellations or non-attendance may result in forfeiture of your fee.

  • We reserve the right to refuse service where clinically appropriate or where behaviour is abusive or inappropriate.

6. Products & Orders

All product descriptions are provided for general information only.

We make reasonable efforts to ensure accuracy of information but do not guarantee that product descriptions, pricing or availability are error-free.

We reserve the right to:

  • refuse or cancel any order,

  • limit quantities purchased, and/or

  • discontinue products at any time.

7. Refunds & Returns

We comply with Australian Consumer Law (ACL).

Consumer guarantees under the Australian Consumer Law cannot be excluded. Nothing in these Terms limits your rights under the Australian Consumer Law in respect of guarantees that cannot be excluded.

a) Products

You are entitled to a replacement or refund if a product is faulty or not as described.

Due to the nature of herbal and consumable products:

  • we do not offer refunds for change of mind

  • opened or used products cannot be returned for hygiene and safety reasons

b) Consultations

Consultation fees are non-refundable once services have been provided.

Cancellations and rescheduling are subject to the notice periods set out in our Refund & Cancellation Policy.

c) Programs 

Fees for structured programs (including multi-session or front-loaded programs) are subject to the specific refund and cancellation terms outlined in our Refund & Cancellation Policy.

Refunds will not be provided for change of mind after a program has commenced unless required under Australian Consumer Law.

If a dispute arises under these Terms, the parties agree to first attempt to resolve the matter through good faith negotiation before commencing formal legal proceedings.

8. Limitation of Liability

To the maximum extent permitted by law:

  • we are not liable for any indirect, incidental or consequential loss arising from use of our website, products or services

  • you accept full responsibility for your use of any information or products purchased from us

Nothing in these Terms limits your rights under the Australian Consumer Law.

9. Intellectual Property

All content on this website including:

  • text

  • images

  • logos

  • branding

  • programs

  • downloadable resources

is the intellectual property of Tree of Health.

You may not copy, reproduce, distribute or use our content for commercial purposes without written permission.

10. Website Use

You agree not to:

  • misuse or attempt to hack the website

  • upload malicious code

  • interfere with website operation

  • use the site for unlawful purposes

We may suspend or terminate access if these Terms are breached.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy, available on our website.

By using our website and services, you consent to the collection and use of your information as outlined in that policy.

12. Changes to These Terms

We reserve the right to update these Terms at any time.

Changes will be effective once published on this page. Continued use of the website or services indicates acceptance of the updated Terms.
